Praise be to Allah, prayers and peace be upon Our Prophet, Muhammad, his family members, companions and followers until the Day of Judgment – Amen!

The Assembly of Muslim Jurists in America (AMJA) watches with utmost grief and ultimate condemnation the remarks made by Pope Benedict XVI, Head of the World Catholic Church that insulted Islam and Muslims, in his lecture at Regensburg University. These remarks bespeak of negligence or rejection of the simplest facts of Islam, which is inappropriate to a man of his age and theological rank; for he is almost 80 years old, who spent his whole life in theological studies, and occupied the rank of professorship at the university, and established the science of theology there, and held theological positions until he became the Pope a year ago!In spite of all the disgusting feelings and condemnations that swept the whole Muslim world in general, and AMJA’s members and experts in particular, because of these rude remarks, we will pursue the Islamic way of arguing with its opponents, and we will be guided by Allah’s saying: “And dispute ye not with the people of the Book, except with means better (Than mere disputation)", (Quran, 29:46). We will address Pope Benedict XVI and the world behind him, in a calm and serene talk, hoping to establish the proof and meet the obligation!

Who are we?We are followers of a religion who believe in Christ that he is a word of Allah and a spirit proceeding from Him, and we as highly respect and honor him as much as we love the Prophet of Islam, Muhammad, prayers and peace of Allah be upon him. Our religion which its Book says about Christ: “Behold the angels said: O Mary God giveth thee glad tidings of a word from him: his name will be Christ Jesus, the son of Mary, held in honor in this world and the hereafter and of (the company of) those nearest to God; He shall speak to the people in childhood and in maturity. and he shall be (of the company) of the righteous”, (Quran, 3:45-46); and it says about Christ’s Mother: “Behold the angels said: O Mary God hath chosen thee and purified thee chosen thee above the women of all nations”, (Quran, 3:42); and it also says: “And Mary the daughter of Imran, who guarded her chastity; and We breathed into (her body) of Our spirit: and she testified to the truth of the words of her Lord and of his Revelations, and was one of the devout (servants)”, (Quran, 66:12); and it says about the nation of Christ: “and nearest among them in love to the believers wilt thou find those who say, we are Christians: because amongst these are men devoted to learning and men who have renounced the world, and they are not arrogant”, (Quran, 5:82).

First: About the Absolutism of the Divine Will:

The Pope mentions in his talk: “That Allah in the Islamic creed is Absolute in Supremacy, and His Will is not tied to anything of our sayings, not even to reason”, then he held a comparison with the Christian thought which is saturated with Greek philosophy, claiming that Christian thought favors reason and rejects anything that opposes it, mentioning as an evidence of this a quotation from the first paragraph of the Genesis, which is the first sentence in the Scripture as a whole, which was used by John in the beginning of his gospel, by saying: “In the beginning, it was the word, and the word is a reason and a word in the same time. The reason is creatable and transmissible, on condition that it should stay sober and mature. John presented us by this the final word of the concept of God in the Scripture. In the beginning, it was the word and the word is God. The meeting between the message which is conveyed by the Scripture and between the Greek thought did not come by chance”, (it must be noted here that this sentence did not come in the beginning of the Genesis, as the Pope mentioned, but it was as follows: “In the beginning, God created the Heavens and the Earth”.
As for the absolutism of the Divine Will, it is the consensus of all Muslims, or rather, the consensus of all the Divine religions before it is touched by man’s hand to be altered and distorted. But this represents only half of the truth; and the other half is what the Islamic Shariáh scholars have all agreed upon that the Will of Allah is indispensably tied to His Wisdom and Justice; for He does not will a thing which is contrary to wisdom or to truth, because He does not create anything false, and does not ordain anything absurd. Rather, He is Wise in what He creates, and Wise in what He ordains. His saying is truth and His rule is Justice; for He says: “The word of thy lord doth find its fulfillment in truth and in justice: none can change his words: for he is the one who heareth and knoweth all”, (Quran, 6:115). He is the Just Ruler, as it is recurrently mentioned in the Holy Quran, and this is read by all people, and they know that His Will is not connected to anything false or to injustice; for how could this be and He who created the Heavens and the Earth by truth and revealed the Book by truth, and He prohibited injustice upon Himself, and made it prohibited among his creatures, and He does not do except goodness and wellness for his creatures, as the Prophet Muhammad, prayers and peace of Allah be upon him, says while he was in soliloquy to His Lord: “Goodness is in Your Hands, and Evil is not unto You”.

Second: About the Relationship between Islam and Reason:

If the first sentence used by John in the beginning of his gospel is, as the Pope says: in the beginning it was the word, the first word revealed in the Holy Quran upon the Prophet Muhammad was Allah’s saying: “Read! in the name of thy Lord and Cherisher, who created", (Quran, 96:1), which is a call to reading and a call to science, and no book other than the Quran calls people to investigate and think of matters, and honors reason and gives it a high esteem. Its verses which are read by all Muslims in the whole world are evidence of this. The Quran praises reason, and makes it the anchor of obligations; for it is the compos mentis. It is a solid rule in our Islamic Shariáh that who has no reason has no obligations assigned to him, and Allah has ordered people to use their reasons and to think of the galaxies and the realms of heaven and earth, so as to reach truth that Allah has sent His Prophets and Messengers with, as He says: Say: I do admonish you on one point: that ye do stand up before God, (it may be) in pairs, or (it may be) singly, and reflect (within yourselves): Your Companion is not possessed: he is no less than a Warner to you, in face of a terrible Penalty”, (Quran, 34:46). And He faults the atheists that they abandoned using reason to understand His revelations and He likened them to beasts, as He says: “The parable of those who reject faith is as if one were to shout like a goat herd, to things that listen to nothing but call and cries: deaf, dumb, and blind, they are void of wisdom”, (Quran, 2:171); and: “For the worst of beasts in the sight of God are the deaf and the dumb, those who understand not”, (Quran, 8:22). There are many verses in this connection, which are open to the whole world; for reason is the basis of transmission or tradition, and without reason, tradition would not be established, and revelation would not have been proved; for establishing Prophecy is judged only by reason. It is a priori in the religion of Islam that science precedes belief, and belief is its fruit, as Allah the Almighty says: “And that those on whom knowledge has been bestowed may learn that the (Quran) is the Truth From thy Lord, and that they May believe therein, and their hearts may be made humbly (open) To it: for verily God is The Guide of those who believe, To the straight Way”, (Quran, 22:54). Therefore, Allah has made science precedent to belief and a fruit of it. Islam does not know any contradiction between a good reason and a clear text, and this is a challenge to the whole world, and they are invited to bring forth one example that would negate this fact. Muslim scholars have great references and vast literature in the subject of preventing the contradiction between reason and tradition, which have become as total rules and general principles and as a legacy of pride for the human thought as a whole.

It remains to remind you that Muslim scholars have stipulated that Islam and all the other divinely revealed religions before being distorted and manipulated do not come with what reason considers as impossible, but they can come with what reason can be confused about or astonished with, and this is what they mean that Islamic Shariáh may come with what makes reason confused and perplexed, but it does not come with the impossible of it, because the vastness of the universe and the number of its galaxies and orbits, its sizes and the spaces that separate them from each other, make the reason perplexed, but it does not approve at all of it being impossible or false.

Third: About Constancy and Evolution in the Significance of Allah’s Words:

For further clarification of truth about the extent of the Pope’s comprehension of the Islamic concept, we follow up his speech in a clerical seminar on Islam in September 2005, about the capability of Islam to develop and evolve, which he strongly rejected by saying: “The word of God with Muslims is an eternal word that never changes, and it is unable to adjust or adapt with innovations or interpretations, and this is a fundamental departure with Christianity and Judaism; for the word of God with them both has been entrusted with the humans, who are themselves are entrusted with modifying and manipulating it so as to adapt with the innovations”. To correct this distorted concept, we say that Allah’s words could be emphatic or assumptive, and only Allah the Absolute Wise, knows wisdom behind this, and if He wills to make all His words to have only one definite meaning, nothing would have prevented Him from doing so, but He made the definitive words that represent the perfect Shari’ah upon which the consensus of the Muslim Ummah unify and upon which their religion is based; and He made some of His words assumptive which represent the realm of flexibility and expansion in this creed, so as the whole Muslim Ummah is not kept closed just in one judgment of opinion or in one interpretation. Thus, the significance of Allah’s words combines between constancy and evolution, between the definitive and the assumptive, and between the perfect and the doubtful. For this reason, the Islamic Shari’ah has assimilated countless events and happenings, and Allah’s rulings have been shown and explained, and the Islamic library comprises hundred of thousands of Fiqh treasuries that contain the best of individual independent judgments and accurate deductions and what man needs in all time and in all places. It did not limit new approaches, or confiscate an innate nature or quell a real human need, and it did not coerce anyone. Our Fiqh scholars and doctors of Shari’ah are still talking about changing the Islamic rulings according to the changeability of place and time, and about the human interests and benefits and their roles in deduction of rulings, and about the necessities and its Fiqh, and the needs and of handling them as necessities in making the prohibited permissible, in a very wonderful Shari’ah system of accurate rulings and perfect judgments that attracted the attention and captured the admiration of the whole world, and this is, I do not think that this fact is absent from a man of the age and the knowledge of the Pope. The contemporary Fiqh assemblies still discuss and find solutions to the emerging happenings and temporary events that befall the Muslim Ummah: they introduce formulas and alternatives to the prohibited transactions in a system that combines between maintaining the genuineness of the Shari’ah and assimilating the spirit of the age, and they never make a truly prohibited matter permissible, nor a clearly permissible matter prohibited, and they never change a consensus ruling, nor trespass what Allah and His Prophet have ruled. Hence, the perfection of the Islamic religion and the infallibility of the Islamic Shari’ah, and the Muslim Ummah keeping away from falling into committing mistakes and grave sins.

Forth: About the Concept of Jihad in Islam:

The Pope croons about a recurrent and a repeated issue, by claiming that Islam has spread with the sword, which means that the wars and battles that it went through were to coerce people to belief. Then he goes on in explaining that this was against the logic and nature of things, and even to the Nature of Allah Himself that It does not like blood shedding, but rather, His Nature makes the word, and convincing is the only way to belief. The assured fact that Jihad in Islam is legislated to fend off oppression and prevent aggression, and not for coercing people to belief, whether this aggression is actually happening, as it is called the Jihad of fending off, or expectant with true signs of transgression, as it is called the Jihad of demand. A clear example of this is the following definitive verse from the Quran: “Let there be no compulsion in religion: truth stands out clear from error: whoever rejects evil and believes in God hath grasped the most trustworthy hand hold, never breaks. and God heareth and knoweth all things”, (Quran, 2:256). All the battles and wars that the Prophet Muhammad, prayers and peace of Allah be upon him, has gone through were in this context, as it is found out by historians and scholars of his Sirah (biography), because the Muslim Ummah is a nation of guidance, and not of transgression and aggression, and wherever it is possible to win people by faith or security, that must be adopted well; for Allah does not make it permissible to kill people except for the wellness of humanity, and as a fending off aggression and transgression, that Allah may bring forth from their offspring who would sincerely worship Him Alone, as he says: “Fight in the cause of God those who fight you, but do not transgress limits; for God loveth not transgressors”, (Quran, 2:190).

What the Pope has mentioned that coercion harshly surpasses faith in logic, and because of a wisdom intended by Allah the Almighty, though it is correct as a whole, yet it has no relation to Islam at all. The Pope is just slandering Islam by his remarks. And if the Pope is talking with the background of some events of violence that happen in different parts of the world, I do not think that one like him is not aware of the fact that violence is a global phenomenon that devastates all nations and all religions, and that what happens of violent acts in some parts of the Muslim world or by some Muslims, we can say that some of it is legal and legitimate and no one can deny that, except those who are doing injustice to themselves, which can be considered as legal resistance acts, that are approved by all divine religions and international positive codes of law, like what happens on the lands of Palestine, Iraq, and Lebanon, and on other occupied parts of the Muslim world, just to fend off aggression and push away transgression, the similar of which if occurred on a country like the Vatican, the Pope would have done nothing except declare war and take part in the resisting forces, and would tour all his people to fend off the aggression and kill the aggressors! The other form of violent acts is illegal and illegitimate, like the events that occurred in the United States of America and in London and in other countries, and this kind of violence is condemned and shunned by all Muslims and they consider it as sheer violation of Islamic legality rules. This kind of violence, though its reason is what befalls the Muslim Ummah under the world’s hearing and seeing, yet this does not justify such acts and would never give it the seal of legality by all means!I do not think that the Pope knows not what is connected to Europe to violence in the course of its past and present history, whether in its internal conflicts or in its disputes with the Muslim world, starting from the crusades and ending with the imperial colonization in the modern era?! Hans Kong, the Swiss theologian and the former professor at the German universities, and the founder of the project: “The Universal Morals”, in the context of criticizing the Pope of the Vatican: “He (the Pope) has put violence and Islam in one basket, and ignored what is connected with Christianity on the course of history of violence”. Professor Kong continues to say: “Muslims do not only remember the crusades, but they also remember the European colonists in the 19th century which extended from the Atlantic Ocean to Malaysia”.

Fifth: The New Thing that the Prophet Muhammad, prayers and peace of Allah be upon him, has Brought:

The limit of encroaching and transgression reaches its climax when the Pope quotes in his speech the saying of the Byzantine Emperor in his alleged dialogue with the Persian Muslim: “Show me just what Mohammed brought that was new, and there you will find things only evil and inhuman, such as his command to spread by the sword the faith he preached”.Away from doubt that embraces this narration in principle, and from his mentioning of what the Emperor has said, and his silence about the Muslim man’s answer to him, which is a sheer violation of neutrality and objectivity rules, the astonishment rises high about this quotation, which I think the Pope himself is aware of its injustice, distortion and unfairness, that no rhetoric of any man can convey!In the beginning, we assure that the Prophet Muhammad, prayers and peace of Allah be upon him, was not unprecedented of all Messengers of Allah; because he came with what all the Prophets came with before him, of Monotheism, and the Fundamentals of Divine Shariáhs, like calling for worshiping Allah alone, and disbelieving in what they worship other than Him, calling to abide to good manners and morals, and preventing vice and sins, and other principles that all the Prophets have agreed upon, because the Prophet Muhammad, prayers and peace of Allah be upon him, is the Final Messenger in the construction system of the Prophet hood, who perfected it in all time. He says about himself: “I have been sent just to complete the good manners and morals”; and “I and the Prophets before me, like a man who built a house and beautified it, except a place of a brick in a corner, and the people would come and tour the house and admire it and say to him: “Wouldn’t you have put this brick?!”, and he says: “I am the brick and I am the Final and the Seal of the Prophets”.

Furthermore, Allah the Almighty has assigned him with a group of characteristics that distinguish him and his mission, and this is a fact that no one could deny except the one who is described with sheer ignorance or complete slandering!We can not imagine that the Pope, who is the Head of the Catholic Church, does not know that the Prophet Muhammad, prayers and peace of Allah be upon him, is the one, with his religion, has removed the sins and the restrictions that were imposed on the sons of Israel who committed aggression, diversion and violation of Allah’s rulings!

We can not imagine that the Pope, who is the Head of the Catholic Church, does not know that the Prophet Muhammad, prayers and peace of Allah be upon him, is the one, who came with a perfected system of Shariáh rulings and civil rights legislatures that attracted the admiration and astonishment of his critics before his followers!

We can not imagine that the Pope, who is the Head of the Catholic Church, does not know that the Prophet Muhammad, prayers and peace of Allah be upon him, is the one, who came with a complete system of manners, morals, and etiquette that govern international relations in peace as well as in war times, that the contemporary international treaties would be dwarfed, as acknowledged by the lawmakers from his own religion.

We can not imagine that the Pope, who is the Head of the Catholic Church, does not know that the Prophet Muhammad, prayers and peace of Allah be upon him, is the one, who declared equality among the human race and demolished discrimination among people on the basis of color, ethnicity, or languages, and he did not put a measure of preference among them except by piety.

This has been embodied in the fraternity treatment that prevailed in his city, Al-Madinah Al-Munawwarah, and this concept in the Muslim society has been handed over and has become a landmark and a milestone of the Islamic contribution to world civilization and pride for humanity as a whole!

We can not imagine that the Pope, who is the Head of the Catholic Church, does not know that the Prophet Muhammad, prayers and peace of Allah be upon him, is the one, who introduced to humanity the harmony between the body and the soul, the reason and the heart, and life in this world and in the hereafter.

He fulfilled the human materialistic demands, as well as satisfying the spiritual compassions, in a very wonderful and harmonious manner. He also came with the moderate and tolerant religion between the extreme monasticism and devastating materialism!This is just a drop from a sea, and the significance of it lies in comprehending it well!

Could what the Pope has said be considered just as a venial sin or a mistake?

Finally, it is hard to accept the Pope’s words as an accidental slip or as an unintended error, as some considered President George W. Bush’s words, while he was talking about his leadership of crusades at the beginning of the chain actions of what he called: “War on Terror”, because the Pope’s words came in the context of a lecture he delivered. He is an academician who studied in the university for many years, and attained the rank of Professorship, and with which he established the science of theology, and he represents a church that believes infallibility of its men, and audits their statements and announcements before publishing them, so as to avoid any consequent criticism. The church usually does not pull its mistakes and errors except after hundred of years from committing them!

Also, it is very hard to separate this word from the autobiography of the Pope who, unfortunately, bears passive feelings towards Islam and the Muslim, which are multiple in his statements and declarations, whether before his papacy position, like when he made a statement in 2004 when he was the Head of Theologians in the Vatican, in which he expressed his opposition to joining Turkey to the European Union because it is a Muslim country!, or in his career as Head of the Church in his country, like when he made a reception to some Muslim representatives in Colon by saying that: “Muslims must take out hate and malice from their hearts, and fight all kinds of fanaticism and all acts of violence that would be ensued from them”!; and like when he received the Italian writer who resides in the United States, Oryana Falacci, who conspires against Islam and Muslims in her writings, and who blemishes Islam as a whole with extremism , and who does not see any difference between an extreme Islam and a moderate Islam!

Is the Regret the Pope Expressed Considered as an Apology of his Remarks or a Pull from it?

What the Pope has regretted about what he said that he feels sorry after he has seen his words about Islam that it spread by blood shedding, was abusive, by saying that he respects their religion, and he hoped that they understand “the real meaning” of his words.
Actually, such regret does not avail in this respect, because the problem does not lie in “his intention”, but in the content of his words, besides, that this content is the preferred subject, in the past and in the present time with Benedict XVI, i.e. the adjusting between “science and religion”, or between “reason and creed”, and this is an old-new “ecclesiastical problem”.

His talk about it can not be considered, as it was explained above, as an accidental error or an unintended mistake. Hence, was his talk about Islam in his lecture – on the best of explanations – as an example which he wanted to convey by saying that the contrast “in what the speaker claims” between religion and reason prevents the dialogue with the others?!
From the other hand, this regret bears an insult of assuming that Muslims are ignorant and narrow minded and undeveloped to the level that would not qualify them to understand his words, and therefore, he is sorry for their miserable condition!As for the saying of some that the Pope has just quoted the saying of a Byzantine Emperor, and that he does not necessarily mean by it that he adopts its content, we say that such saying can not be accepted in this connection, because the Catholic Pope, of the German origin, and the German speaking pontiff, to the German audience, and on German soil, could have, if he would, quoted the German Emperor Gallium II from what he said about Islam a century ago instead of quoting the Byzantine Emperor Emanuel II six centuries ago; or from what Goethe, the most celebrated German poet and philosopher, or from others, who are many, of the German and non-German philosophers in the European Era of “Illumination”.

Manners and Etiquettes of Dialogue:

As for the Pope’s saying that he absolutely supports the dialogue between religions and cultures, we say to him: “Dialogue has its own manners and rules, once the parties involved abide by them, the dialogue would be fruitful and constructive, otherwise, it would open up avenues for futile arguments and excitement of hatred and malice, which would not be useful to the cause of the dialogue, or even it would bring forth the opposite of what it is intended for.Finally, the Pope can choose to not believe in Allah and His Messenger as he wants, and to misunderstand His prophet and his mission, as he wants, because it is up to him to do so, and we have nothing to do with that, and that he will come back to his Lord who will bring him to accountability for his deeds and sayings. However, would he turn this religion into insulting and saying falsehoods, this is what we are talking about right now, which is rejected by the logic and rules of dialogue which the Pope raises its banner and opens its doors!We are in dire need these days, which conflicts have worn it out, and disputes made it miserable, to the voice of wisdom which the sages of the world, on all their nationalities, religions, and ideologies, call for, to avoid the human race the horrors of these devastating wars, and pave the way for peaceful and serene co-existence, in which all people walk and strife with the hope of attaining Allah’s content and gaining His Providence, and make acquaintance with the guidance of His Prophets and Messengers, and seek His obedience and pleasure, away from fighting, insulting, and destructing, which does not avail either the worldly life or the principles of any religion.

Allah is the Object of our intent; for He is the One Who leads us to the Straight Path
